DPP Will Appeal Ruling

But first to the DPP. When she emerged from the Chief Justice’s court room, Director of Public Prosecutions Cheryl Lynn Branker Taitt appeared to be undeterred by this morning’s ruling. The DPP says she plans to appeal the decision forthwith.

“I was surprised by the reasoning for the judgement but when one gets a judgement one is not satisfied with one doesn’t comment or rant or rave, one simply appeals and that is what we’re going to do.”

Janelle Chanona,
You will appeal to where? How does that process work, you’ll come back to the Supreme Court?

Cheryl Lynn Branker-Taitt,
“Appeal to the Court of Appeal.”

Janelle Chanona,
Tell us the grounds that you will be appealing on.

Cheryl Lynn Branker-Taitt,
“When we file the notice of appeal I am sure you will be able to read it and see.”

Janelle Chanona,
So the message is that your confidence is not misplaced.

“Certainly not.”

“But by the judge’s ruling it seems as if those you and him were on totally different wave lengths.”

“As I said Marion when one is not satisfied with a judgement, one appeals.”

How early will you be filing that appeal?

Cheryl Lynn Branker-Taitt,
“We have 21 days within which to file the appeal. We will be proceeding with that.”

According to the DPP, the appeal would only be in respect to the case of the committal order against Said Musa and the charge she would seek is theft.
