Court of Appeal Quashes Brian "Bido" Herrera's Murder Conviction

Another convicted killer got off in the Court of Appeal today. Twenty four year old Brian Herrera known as “Bido”, who was convicted of the murder of 49 year old Eugene White Encalada known as “Witch”, was acquitted today by the Belize Court of Appeal. The appeal by Herrera, who was represented by Attorney, Hubert Elrington, succeeded on the ground that the prosecution failed to produce proper identification and evidence.

Encalada was shot and killed on the night of October 17th, 2007, while he was walking on Dean Street near its junction with Euphrates Avenue. His assailant rode by on a bicycle and shot him. Police apprehended Herrera shortly after the shooting after he jumped a fence between Tigris and West Streets. A mask was found in the area. Herrera was tested for gunpowder residue but none was found on his hands.

Initially, Herrera was also charged with the murder of 43 year old Winston Charles Castillo, who was shot and killed at the corner of George and Church Streets shortly before Encalada was killed. However, the charge was withdrawn due to lack of evidence.

Although Herrera was acquitted, he was not allowed to walk free since he has 6 months left to serve of a 3 year sentence he received in October of 2007. He was found guilty of keeping 40 rounds of ammunition without a gun license. The ammunition was found when he was apprehended by the Police in connection with Encalada’s murder.
