"Cowboy" Gets Off Murder; DPP Wants Appeal

Kevin Cowboy Alvarez - he's a former cop who graduated to urban legend status in March of 2009, when he was accused of carrying out a contract killing on a Chinese Grocer in Orange Walk and then running from police into the New River, where he rose up with two handguns firing simultaneously, injuring two constables.

Well, last week, he went to trial in the Corozal Supreme Court only for the charge of murder of Chinese businessman Hui Lin Chen. With police being amongst the chief witnesses - you might think the prosecution would have the edge in this one. But not…. After the prosecution closed its case having called 21 witnesses, among them Ann Gonzalez and police constable Joaquin Castillo, Cowboy Alvarez's attorney, Kevin Arthurs today submitted that his client does not have a case to answer.

Arthurs' submission was based on poor identification evidence from Gonzalez and Castillo. The trial judge, Justice Denis Hanomansingh, upheld the no case submission and directed the jury to return a formal verdict of not guilty.

Crown Counsels Trienia Young and Christophe Rodriguez represented the prosecution. But that's not the end of it. This evening, the DPP, Cheryl Lyn Vidal told us that her office intends to appeal the decision of the judge to allow the no case submission. Her office is of the view that the prosecution started out with sufficient evidence to prove the offence but a certain part of that evidence was not admitted at the discretion of the judge; Vidal said, quote: "the DPP's office very respectfully disagrees with the exercise of that discretion so we are appealing the matter to the court of appeal," end quote.

In the time being Alvarez had a brief taste of freedom after almost three year son remand when Corozal set him free after the acquittal. But, he still has attempted murder charges pending for allegedly shooting two police officers in the same incident so he remains in custody of Corozal police tonight.

He can, however, apply for bail on those charges.
