Men Convicted: Stabbed & Threw Snow Cone Vendor In River

Yesterday in the Western Session of the Supreme Court, 19 year-old Leonel Daly, and 36 year-old Abelino Briceno Jr. were convicted of attempted murder and robbery. It was alleged that the attacked and robbed 45 year-old Leonardo Velasquez.

In the trial which started on April 2, Crown Counsel Cecil Ramirez called 7 witnesses, but his key witness was the victim himself.

Velasquez, a shaved ice vendor, testified that on September 20, 2010, at around 11 p.m., he was walking on the side of the road in the Savannah area of San Ignacio. He said that at around that time, Daly and Briceno attacked him, stabbed him twice in the left side of his chest, and robbed him of $23.

He told the court that the men then threw him in the river and left him for dead, but he was able to swim to the other side, where he collapsed from the injuries he received.

At around 4 a.m. the next day, he was discovered by residents of the area, who called the police. Velasquez was rushed to the hospital where the attending doctor was able to perform life-saving surgery on the wounds.

In their defense, Daly and Briceno, who were unrepresented, called their own witness. Briceno called the 3 people who discovered Velasquez. He attempted to provide evidence to the jury that the area was dark, and that Velasquez couldn't have seen his attackers.

Daly went for a different tactic, and he called 2 witnesses who attempted to provide him with an alibi defense.

In response to Briceno's defense, the jury requested to visit the crime scene. They visited the area where Velasquez pointed out to the jury that on that night, there was a traffic jam, and the headlights of the vehicle provided enough lighting for him to see Briceno's and Daly's faces.

The jury deliberated for about an hour and a half, and they returned with guilty verdicts on both charges for both accused persons.

Justice Gonzalez has given both men until April 11 to prepare mitigation pleas, after which he will deliver his decision on their sentence.
