The minor testified that on July 13, 2011, she was sitting on the verandah of Little Wilt's Place on Caesar Ridge Road. She asked Middleton to use the bathroom, and he showed her where it was. The minor continued that when she went inside, Middleton followed her and had intercourse with her.

She didn't report the incident, and it was only when her mother saw signs that the incident was reported to police. The mother testified that when she discovered what had happened, she confronted Middleton who allegedly tried to bribe her to keep quiet with a promise to pay the child's school fees. She said that she took her daughter to police who eventually arrested and charged Middleton with unlawful carnal knowledge.

When he was given a chance to provide a defence, he gave the court alibi evidence claiming that he wasn't in the location at the time. He also called a witness who attempted to corroborate his testimony. The jury, however, didn't believe him, and after deliberating for a little more than 3 hours, they returned with a verdict of guilty.
