Appeals Court Rules Ashcroft Alliance In Awich Challenge

And the final decision from the Court of Appeal which we report on tonight concerns the sitting Justice of Appeal, Samuel Awich.

That's the case where the Ashcroft Alliance, namely, Dean Boyce, British Caribbean Bank - now named Caribbean Investment Holdings Limited, and Lord Michael Ashcroft himself, was challenging Awich's appointment to the Court of Appeal.

They filed a lawsuit against the the Judicial and Legal Services Commission, alleging that the commission did not take their complaints against Awich seriously. They alleged that Awich had performed inadequately as a Supreme Court judge, and should not have been eligible as a justice of the Court of Appeal. Justice Courtney Abel (able) ruled against the Government, and in favor of the Alliance, finding that the commission should not have dismissed the complaint. Justice Abel said that the complaint should have been sent up the Belize Advisory Council.

The Barrow Government disagreed and appealed the case. After months of deliberation, the Court of Appeal completely reversed the ruling of the Supreme Court, and found that the Ashcroft Alliance complaint against Awich was frivolous. The Appeal Court found that the Commission was right in dismissing the complaint. The Solicitor General discussed the case with us via phone this evening:
