Charlie Good's Family Suing Police for his Death
posted (November 6, 2009)

As the family of Charlie Good gets ready to lay him to rest on Saturday, a law suit is in the process of being filed against the Ministry of National Security and Minister Carlos Perdomo for allegedly causing the wrongful death of the sixty two year old. Attorney Arthur Saldivar who is representing the wife Hirian Good told 7News that it is a wrongful death lawsuit that will be filed and the decision was made because of the autopsy result. The medical examination conducted by the government pathologist Dr. Mario Estradabran states that good died as a result of neurogenic shock, acute pancreas haemorrhage, diabetes type two, hypertension and chronic heart disease.

And while it is regrettable that Charles Alexander Good has passed away some may argue that due to existing medical conditions when he started his protest in August, he may have contributed to his own death when he put his own frail health at risk during the days of protest he and his wife conducted. But according to attorney Saldivar, Hirian Good believes that her husband died as a result of the police assault he was victim to in September.

According to attorney Saldivar, both the neurogenic shock and the acute pancreas haemorrhage can be attributed to trauma when he says Charles Good was assaulted by several police officers and the major cause as to why Charles Good is dead. He’s a lawyer, not a doctor, but he feels he has a case.

Arthur Saldivar, Attorney for Good Family
“There is sufficient footage, file footage from the various media houses that show what took place and in fact on that particular day Mr. Good had gone to the KHMH to receive treatment. He did receive treatment and subsequent to that had complained about pain and about a trickling that he felt within his abdominal region. I am not a medical doctor but I did consult one to avail myself to the information. What I have been told is that when you are talking about haemorrhaging of the pancreas, that could be brought about by some blow to the upper abdomen and Mr. Good had complained that he had been stomped all over his body by police officers day. In fact eight police officers went there to apprehend an unarmed man and they did not put him gently in the vehicle. In fact they took him like a sack of rice and threw him into the back.

Mr. Good was not on a hunger strike. He had hinted at going on a hunger strike but he never actually engaged in that activity. His protest was simply to be there at that particular location opposite the court with his placards, standing beside his wife, supporting his wife in her struggle but he never did anything of his own volition to basically complicate his illness and bring about his demise.

If he was allowed to resolve this issue the way the powers that be stated they would be willing to resolve it, then he would have been able to get the medical attention needed to avoid this situation from occurring. It is a sad situation, it is a situation where I believe had the Minister of National Security exercised some compassion and understanding, he would have understood that there was some level of responsibility to borne by that particular Ministry in what took place and then Mr. Good would have gotten the financial assistance which would have led to him being able to seek the medical health that he needed to avert what took place and a family would not be at this particular point without a father and a young mother without her husband.”

According to attorney Saldivar they believe it is a strong case and that they have more than just video of Charles Good being assaulted by police officers to prove their case in what they believe to be the wrongful death of Charles Good. Saldivar adds that Charles Good had undergone surgery several months before the police assaulted him and the attack on him could have also affected his health.
