Finally an Arrest In Case Of Molested Child
posted (January 17, 2012)
It was one of the most shocking and sensational stories of last year when news broke in September that a four-year old had been sexually molested.

The details were lurid - and we have to repeat them tonight, so the rest of the story is definitely not suitable for children. She was allegedly infected with an STI, experienced a rupture, and was allegedly pointing to multiple suspects from incidences or repeated abuse.

The outline of the crime outraged the community - and police said only DNA testing would confirm who had done it. Well, sadly, all that was just excitement; in fact, most of it didn't happen.

And now, finally after four months, one man is expected to be charged tomorrow - and not for carnal knowledge, but for aggravated assault.

That lesser charge is because the medical examiner has confirmed that the accused person did not penetrate the child with his sexual organ, he only fondled her using his hands. So she was not ruptured as had been reported. In fact, the child never said anyone had sex with her; she told investigators that she had been touched.

Secondly, she had no sexually transmitted infection; she did have a discharge but the Doctor found that was hygiene related, not an STI issue.

Thirdly, since there had been no penetration, there could be no useful DNA test because no DNA sample could be extracted from the child. Inexplicably, this whole DNA testing matter was reported by the police press officer, who could not be reached today. So all these months while we were waiting the results of this DNA test to see who had harmed the child, none will be forthcoming. The arrest, it turns out, will be made based on the simple identification made by the child when police interviewed her all those months ago.

So then, what took so long? Nothing, just the usual paper pushing by police. The DPP's office reports that it only got the file yesterday with a recording of the child's complaint. With that the DPP's office today issued the directive that Hector Usher should be arrested and charged with Aggravated Assault. So since no DNA testing could have been done, or was planned, and only one suspect was named by the child, if the DPP has gotten the file in September, charges would have been brought by then.

We've heard of police bungling, but in this case, it seems epic, as the community was left to steam over the overstated circumstances of this still very sad and regrettable crime.
