Men Accused Of Throwing First, Deadly Grenade Get Off

The May 18, 2009 grenade explosion was a terrible day for Belize; it marked the transition from gang warfare to urban terrorism.

Today, the 2 brothers accused of throwing that grenade and causing the death of one, and the injury to eleven others - walked out free from the Supreme Court.

They are 19 year-old Akeem "Baby" Smith and his brother Kareem, also known as "Flash".

Their trial for murder started this week, where Crown Counsel Trenia Young called a total of 8 witnesses to prove her case against the men.

All of the witnesses testified under oath this week and told very different stories from the ones they gave police in written statements in 2008. None of the witnesses provided the prosecutor with any identification evidence that she could use against the two accused.

Today, Young called her 8th witness, and she asked him a total of 20 questions. By the last one, she realized that she couldn't convince him to cooperate for the prosecution's case, so she made an application to treat him as a hostile witness, which Justice Adolph Lucas granted.

There was a brief adjournment, and when the case resumed, Crown Counsel Young told the court that she wished to withdraw her application to treat her witness as hostile, and that she would close her case right at that point.

Attorneys Sharon Pitts - Robateau and Ellis Arnold, who represented Akeem and Kareem respectively, then made no case submissions for the two men.

In directing the jury, Justice Lucas told them that there are five elements which the crown must prove beyond a reasonable doubt against the accused before they can be found guilty, and that the prosecution has only proven that 16 year-old Darren Trapp died as a result of the grenade throwing.

With that, he directed them to return a not guilty verdict against both Akeem and Kareem Smith, who left the court free for the first time since they were remanded in May of 2008.

The grenade thrown in that incident is the only one which resulted in the loss of life though four others have been thrown - but luckily only two of them exploded.
