Gegg Gets Breathing Room On Mega Sales Tax Arrears
posted (December 12, 2012)
Yesterday 7News told you about David Gegg's financial issues with the GST Department for over quarter million dollars in back taxes. Well, he now has 2 months to clear up all his arrears because the court has given him some breathing room.

As we told you yesterday, he was required to show up in court yesterday to say why a committal warrant for him to be jailed should not be executed. But, as we reported, he sent his accountant on his behalf, and the magistrate gave orders that he must show up in person.

So today, Gegg, flanked by his attorney, Andrew Marshalleck, and his accountant, appeared before Magistrate Dale Cayetano in relation to those arrears.

GST Legal Represenative Jacqueline Meighan reported to Magistrate Cayetano that with yesterday's 50-thousand dollar payment, on these arrears, Gegg now owes $146,496.90 on the previous arrears for which the committal warrant was issued.

Marshalleck then submitted to the court that his client would like to ask the court to grant an adjournment of today's proceedings to determine if he can pay. According to Marshalleck, Gegg has taken steps to pay off all his arrears in 2 months' time, so there will be no need for a determination if he is able to pay.

Meighan indicated to the court that her superiors will not object to adjournment, but they will hold Gegg to that time period very strictly.

With that, Gegg was granted an adjournment until February 15, where he must be able to return before Magistrate Cayetano and report that he has settled all arrears.

So, at this point, Gegg owes GST approximately 306 thousand dollars, 80 thousand of which he must pay by December 21, or he will be facing legal consequences…

According to his accountant who addressed the court yesterday, he has advised Gegg to file for bankruptcy to clear up his debts because the profits from his two companies are less than what is reported due to unbudgeted and unforeseen expenses which aren't documented on the GST returns.

The accountant said that Gegg has so far refused to accept his advice, and indications to 7News are that he doesn't plan to any time soon.

We have confirmed that a company in which Gegg and his wife are principals, has secured loan of more than a million dollars from the Development Finance Corporation. According to our sources, the loan is sufficiently secured with property put up by Mrs. Gegg.
