Man Gets Off Murder, Witnesses Had Differing Accounts Of Clothing

23 year-old Dwayne Evelyn, the man who was charged with the February 2010 murder of 22 year-old Peter Myvette is at home tonight after he was freed by a jury of 12 in the end of his murder trial today.

Viewers may remember that at around 12 in the afternoon on February 17, 2010, Myvette was washing a bus door at the corner of Tigris Street and Kut Avenue when a gunman rode past and shot him multiple times in an area crowded with school children. Evelyn was arrested and charged for the murder a couple days later because the crown's 2 chief witnesses linked him to the crime.

So Evelyn was forced to wait on remand for 3 years, and when he faced his accusers in the murder trial before Justice Lucas this week, their story did not add up to the jury.

One civilian took the stand and said that the gunman wore a mask when he launched the attack on Myvette, and a police officer testified that he was on West Street when he heard the gunshots. He said that he responded, he saw Evelyn, who he knew very well, removing a mask and throwing it away.

But, both witnesses couldn't agree about what color clothing Evelyn had on that day, which was an added difficulty in the crown's case since no one actually claimed to see Evelyn himself as he supposedly pulled the trigger.

So, the jury deliberated for over 3 hours, and when they returned, they unanimously found him not guilty, setting him free. He vacated the courthouse very quickly.

Crown Counsel Kayshia Grant represented the prosecution, and Attorney Simeon Sampson represented the defence.
