His trial took place before the Chief Magistrate, Ann Marie Smith, where the 12 year-old testified that on May 11, 2013, at around 2 p.m., she went to Dakers' house to beg him for a nail. She said that Dakers told her that he didn't have any, and when turned around to leave, Dakers squeezed her buttocks. She said that she immediately told her mother who called the police and reported the incident.

Dakers was charged with aggravated assault of an indecent nature, and in his defence in the trial, he told the court that the child was telling lies on him once again, like she supposedly always does. He denied ever touching the girl.
