Bart Lucas's older sister claims that he was at Chon Sing restaurant with friends when the shooting happened and that she has security footage to prove it. She and a friend who asked to appear off camera told us more:..

"Another bogus charge once again from the police department. The reckless police department who not go out and do their proper investigation. Friday with some shooting with some guys Harris and another gentleman, we were in a restaurant underneath camera with a police officer."

Reporter
"Could you name the restaurant sir?"

Voice of Friend
"Chon Sing. When we go hear about the shooting, we heard about the shooting on the police radio, a police by the name of Garcia. He was with a female companion in the restaurant. They were having food together and out of the restaurant and back in the park and I was there hanging out with Mr. Garcia because he is a friend of mine. Whosoever pick out those boys on a bogus ID parade could shoot somebody. The only way you can do that is if you photocopy yourself."

"The police officers did not go to view the footage, I went and did it. LOVE FM came and did a nice recording of it for me. The police refuse to take the footage from me and they refuse to go to the restaurant and retrieve the video and check it out for themselves. They did not use that piece of evidence. So whether they have eyewitness testimony or I don't know how they decided to lay down this charge - not good. I believe in the innocence of my brother, and I believe his alibi, his socializing and what not on camera."

Despite their protestations - the 3 men, all of them residents of Pinks Alley were charged with the murder of 32 year old Harrison Smith when they appeared today before the Chief Magistrate, Anne Marie Smith. They were also charged with wounding and use of deadly means of harm for allegedly shooting Eustace Lewis in the rear end. Cain alone was charged with aggravated assault and professing to be the member of a gang.
