He stood trial before Justice Troadio John Gonzalez where the girl testified against him as the main witness. She told the court - in a closed session - that between January 20111 and October 21, 2011, Charlesworth had intercourse with her. The child's mother also testified for the jury and explained what her daughter had told her about the sexual violation. A medico-legal form was tendered into evidence in which the doctor who inspected the child says that what he found was "suspicious, but not confirmatory."

In his defence, Charlesworth testified under oath and denied that he had committed the offense, explaining his version that he was elsewhere when this violation of the child happened. After deliberating for 4 hours, a jury of 9 found him guilty in a Majority verdict of 7-2.
