The Many Trials of “Brother B”

You've often seen Prime Minister Dean Barrow's younger brother, Denys, on the evening news as the Government attorney discussing the nature of the court cases that the Barrow Administration is involved in. The lesser-known fact is that he continues to sue the Government of Saint Lucia for pension he is claiming after serving as a judge of Court of Appeal in the Eastern Caribbean Supreme Court for 3 and 8 months.

The Judicial and Legal Services Commission of Saint Lucia's position is that Barrow did not meet the minimum requirements to qualify for pension, but Barrow disputes that position. He has litigated it in High Court, which has ruled against him, and in April of this year, he went to their Court of Appeal.

Neither the Supreme Court nor the Court of Appeal in the Eastern Caribbean Court agreed with his position. He argued the case on his own behalf, with his colleague, Eamon Courtenay, and his daughter, Naima Barrow, as the attorneys on the record. Once again, he was unsuccessful, and the Appeal Court delivered a judgement against him last month. He has since applied for leave to appeal to the Privy Council, which is pending.

And how much pension benefits is he suing for? Well, pension for retired Appeal Court Judges is equal to three-fourths of the annual salary, which is about $55 thousand US dollars. That's one hundred and eleven thousand Belize dollars, so this would mean that Barrow is claiming just over 83 thousand Belizean dollars spread out over a 12 month payment schedule every year.
