Vera Denied Bail Again

For the past month or so, the convicted firearms examiner, Orlando Vera, has been trying to get Supreme Court bail.

He's serving a 2-year sentence for the charge of abetment of the crime of perverting the course of Justice, but he is in the process of appealing. His attorney believes that he is entitled to bail while waiting for the appeal, and they've been trying convince Justice Herbert Lord of that. So far, he's already made 3 applications for Supreme Court bail, and today, he was denied again.

As we told you, there are delays in the court process because the full record of the case needs to be sent from the Magistracy to the the Supreme Court.

It's been taking longer than expected for that to happen, and the delays are not the fault of the prosecution or the defence. But, Vera feels as though he's being punished with remand for circumstances outside his control.

So, he went back before Justice Lord requesting bail again, and his attorney, Anthony Sylvestre, cited that the court ordered dates have not been complied with, and so he is entitled to be out on remand. Justice Lord then informed him that the entire record is almost complete.

So, the judge ruled once again, that since they are so close to getting entire record, he he was not prepared to grant Vera bail. He was about to make an order for the actual start of the case, but he was interrupted.

That's the moment when Sylvestre took advice Vera, and he then made an application, requesting that Justice Herbert Lord recuse himself from the case. Vera believes that he won't get a fair trial, and he complains that the judge has not been strict in enforcing the court ordered dates for the start of his appeal.

In response, DPP Vidal submitted that Vera has no real grounds to make this this application, because he has no clear example of bias that the judge has displayed against him. She pointed out that Vera should not get to demand that a judge recuse himself simply because he disagrees with the judge's rulings.

The judge adjourned the case until next week Friday, when he will be given written submissions from both sides about the case law on recusals.

So, that's yet another delay, and 7 more days that Vera has to wait in jail, but court observers say that it may put Justice Lord in a precarious situation. That complaint of bias against him is an element that has been activated, and it will be interesting see how it plays out. We'll keep following the story.
