Brendan Bain Beats UWI In Freedom Of Expression Case

You may remember Jamaican Professor Brendan Bain. He made news all over the Caribbean when he was fired in May 2014 from his post at the University of the West Indies CHART Program. The University terminated him after they came under pressure from 33 lobby groups and activists organizations all over the Caribbean, for his supposed "anti-gay" testimony in the UNIBAM trial in the Belize Supreme Court.

Well, the Jamaican Supreme Court has ruled in his favor, ordering UWI to pay him 4.72 million Jamaican dollars - about 40 thousand US dollars within three months.. He sued the university for 40 million Jamaican dollars in damage for defamation. The court found that he had a right to freedom of expression. The Jamaican press quotes him as saying that he is relieved that the matter is now over. He has reserved further comment until he has fully studied the judgement.

Bain was fired by the university on the grounds that his constituents had lost confidence in him after he gave an expert report in an affidavit in the UNIBAM case. He attorney made the submission that the statement made by the university that he had lost the confidence of a significant sector of the community the programme was intended to serve was false.

Bain was the director of Caribbean HIV/AIDS Regional Training Network up to the point when he was fired.
