The Titan Matter to The CCJ

We also asked about an appeal that will be going to the CCJ. It's the Titan Securities case, which was completed before the Court of Appeal in June of Last year. 

Back in 2016, Justice Courtney Abel ruled that the Government should pay 8.8 million dollars to Bahamians Rohn Knowles and Kelvin Leach.

The judge reasoned that they deserved that huge compensation for the September 2014 raid at their Titan's Securities, at the Matalon building in Coney Drive. You'll remember that the ADU cleaned out their offices on behalf of the FIU which was working with the US Government based a Federal indictment for Securities fraud.

The Government appealed that case at the Court of Appeal, and last year, even though the court agreed that the search was excessive and unlawful, it struck down that 8.8 million-dollar compensation order from the Supreme Court.

Well, Titan's owners are going to the CCJ to test whether or not the Court of Appeal's reversal can withstand their scrutiny. The Sol Gen granted brief comments on it today:

"I think titan has appealed to the CCJ. If you recalled the court of appeal basically reversed the decision of the trail judge so now we are at the CCJ for case management yesterday. Basically was just to fix dates for hearing and the dates for submissions. I think the schedule hearing date is tentatively fixed for the 15th of May but that may change but that's the tentative date. I think they are to do their submissions by the 16th of April and I think we are to respond by the 30th of April 2018."

"Sir having looked at the case yourself are you able to say if you are of the opinion that you think it will withstand the test of the CCJ's scrutiny?"

Nigel Hawke
"That's a tough question. We feel we have a good case but I really can't try these matters in the press because these matters are sub judice and I don't know how the court will rule we have to go make our arguments but we feel confident in our arguments."
